This Privacy Policy is explanation of how naertnahte ("naertnahte", "we", or "us") collects, uses, and discloses information about website visitors (a.k.a. you). This Privacy Policy applies only when you use this website or contact us (using the methods as they are listed in the Impressum). This Privacy Policy does not apply when you use a different platform (e.g. YouTube) on which content is published by us.
This Privacy Policy could be modified or revised from time to time. If modifications or revisions are made to this Privacy Policy, the effective date will be changed and an announcement will be made on the homepage/frontpage of this website.
Online communication § 1) When you are communicating with us, you are required to provide certain information. For example, e-mailing us will require you to share with us your e-mail address. This does not require you to share with us the password to your e-mail address. When you call or fax us, you are required to share with us your phone number.
§ 2) Sometimes, depending on the context of the communication (e.g. you are being interviewed for a video), you may be asked to provide a name, city of residence, and occupation when communicating with us. This information is NOT mandatory, but we do encourage you provide it—especially if you are being interviewed. This information can still be derived or inferred (from sources including but not limited to television broadcasts, newspapers, your own public social media account), even if you did not provide it to us. If you object to providing us this information (e.g. for the purposes of staying anonymous), it will not be collected.
§ 3) You will never be asked to provide personal information/identifying details, including but not limited to your home address, your passwords, your Social Security number, your date of birth, medical history, etc.

Generally speaking, we use the received/collected information from combinations of the foregoing a variety of purposes, including but not limited to:
- sending you information that you requested or agreed to receive (e.g. general inquiries via e-mail, fax, or telephone)
- fulfilling special requests that you requested or agreed to receive (e.g. advertisements, sponsorships)
- creating audio-visual overlays (e.g. lower thirds, title screens) and the production of supplementary written assets (e.g. a report)
- verifying the accuracy of our political reporting and ensuring the factual and impartial/unbiased integrity of our content
- maintaining an internal archive of our content and reports for future reference, historical record, and editorial consistency
The CCPA provides for certain disclosures about your rights and the personal information we collect/receive, sell, and disclose. The following are your core rights:

RIGHT to KNOW/ACCESS - You have the right to ask us what personal information we have collected, how we collected/received the information, and why/how we are using it.

This right is no longer limited to a 12-month period. Effective 1. January 2023, we are required to provide collected information dating back to 1. January 2022.

RIGHT to DELETE - You have the right to request that we delete any personal information we have collected from you.
- There are certain journalistic exceptions. For example, information that is a "matter of public concern" (e.g. Mayor of Westminster's campaign contributions) is exempt from this right.
- Information that is necessary to "exercise free speech" or to "ensure the right of another consumer to exercise their right of free speech" is also exempt from this right. For example, we are not required to delete your name/residence-city/occupation from a video if you provided us with that information (e.g. at a public protest) on the basis that it would compromise editorial integrity. In other words, you have effectively stepped into the public record.
- Speaking of public records, government records (e.g. city council minutes and court filings) are exempt from this right.
- If your information was already publicly published (e.g. television broadcast, newspaper, your own public social media account), we are allowed to use that information.

RIGHT to CORRECT - You have the right to request a correction of the collected/received information if you deem it to be inaccurate.

RIGHT to OPT-OUT of SALE or SHARING - You have the right to opt-out of the selling/sharing of the collected/received information.
- We neither sell nor share information; we don't run "targeted ads" on our website.
- Therefore, there is not a need to opt-out on our website.

RIGHT to LIMIT USE of SENSITIVE PERSONAL INFORMATION - You have the right to limit and control how we use "sensitive personal information" if we use it outside of our website.
- We do not collect "sensitive personal information".
- RIGHT to NON-DISCRIMINATION - We cannot "punish" you for exercising your privacy rights.
Furthermore, whilst we do handle collected/received information as mentioned from the foregoing, we cannot be forced to hand over such information per California's "Shield Law" for journalism. Upon receipt of a subpoena, a "Motion to Quash" will first be filed. If the motion is rejected and the subpoena is enforced, then by law, we are required to provide the issuing party the requested information. The same applies to search warrants, although these are more difficult to enforce, and the Privacy Protection Act of 1980 and plain California law forbids law enforcement's use of a search warrant.
